Throughout 2020 we talked about how important it is for tenants and landlords to negotiate and make compromises. Confrontation often leads to unnecessary losses and less profit for both sides than to the victory of one of them. However, this does not mean that you should always strive to retain the tenant at any cost. Alena Protopopova, head of the legal department at R2 Asset Management, tells about how the landlord can terminate the contract if it is no longer possible to “live together”.

Hospitality COVID-19 period

Today hotels are experiencing serious problems due to the decrease in tourist flow. This is due to the high level of operating costs in this business: at 60 percent utilization, they account for at least 40% of revenue. With significantly lower occupancy rates this year, many hotels are unable to cover their costs, and those who can do it are not making a profit. And some, like the legendary Hotel Martinez in Cannes, are closing. A distinctive feature of the current state of the market from previous crises is that earlier, with the fall of the ruble exchange rate, the cost of living increased along with the exchange rate calculated for foreign tourists, but today, when foreigners have practically stopped coming, rates are completely dependent on ruble clients and do not react to foreign currency fluctuations, continuing the downward trend.

Experts expect new distress assets to be released

A series of pandemic-triggered bankruptcies can be expected over the next six months. Companies that experienced problems during the first wave and did not survive restrictive measures will gradually complete bankruptcy procedures, and their objects will go on sale in the form of distress assets. The first offers will appear on the market at the end of this year, but the peak of activity will come only by the end of spring - early summer 2021. By this time, the supply of distress assets may grow by 30%.
